Enforcement - meeting your obligations

You, the employer, are responsible for understanding and meeting your legal obligations - remember that ignorance of the law is no defence in Court.

While the Department of Trade and Industry (DTI) will monitor the manufacture and sale of PPE through the local Trading Standards Authorities, in most cases checks that you are complying with the regulations, and their enforcement, will be carried out by the Health and Safety Executive (HSE) - often referred to as the Factory Inspector - or by local authority inspectors.

Work with your local enforcement officers. They will be only too happy to give you help and advice as their main concern is the welfare of yourself and others in the workplace - not taking people to court after something has gone wrong.

Your own trade association should be able to assist you, and it is also a good idea to use an experienced supplier of PPE who provides a proper support service as they will help you to meet your legal obligations, both now and in the future.
